Waiver
Acknowlegment of Risk, Release of Claims and Waiver of Liability
Due to the special nature of the expedition in Patagonia and of the expedition in Antarctica risks cannot be eliminated. We wish to remind you that sailing and other activities in Patagonia and Antarctica are not without risks. We think it is important for you to know what to expect and to be informed of the inherent risks. If anything, we will not ask you to do or take part in any activity we regard as unsafe. We are happy to have a clean safety record and intent to keep it that way.
The following describes some, but not all of those risks:
The hazards of walking on uneven and slippery terrain, mountains, snow covered terrain, the forces of nature, including weather changes, high winds and rough seas, the risks of sailing in general, man overboard, travel in Zodiac, avalanches, calving glaciers, sea ice, the risk of encounters with wild animals, the risk of falling into a crevasse or through the sea ice, the risk of cold including hypothermia, frostbite, floating pontoons, jetties, abandoned buildings, potential for human error. I understand that the description of these risks is not complete. I am aware that the activities associated with the expedition entail risks and that these or other unknown or unanticipated risks may result in injury or death.
I am fully aware that a sufficient insurance for all other incidents that may occur, including medical insurance, is my own responsibility.
I certify that I am fully capable medically, mentally and physically fit to take part in this expedition. Therefore, I assume full responsibility for myself for bodily injury, death, loss or damage of personal property and expense thereof as a result of those inherent risks and dangers, (without limitation). I fully understand that the remoteness of the destination could mean long delays in reaching medical facilities. And there can be no guarantee of air evacuation in the event of life threatening injury or illness.
I am responsible for my own medical evacuation, life and travel insurance for the area visited.
I understand that I shall follow the instructions given by the skipper, crew or guide. Decisions taken out of precaution or safety cannot be discussed. These included rules laid down to protect wildlife, historical sites etc. Changes to the sailing plan beyond our control, like weather, ice, local regulations can be made by the Skipper. There will be no reimbursement.
I am aware that I can be held responsible for damages on persons and equipment if I do not follow the guidelines.
Before signing up for a trip, I must inform Mark van de Weg of any potential serious health condition, including allergies etc.
I will release, acquit and forever discharge Mark van de Weg, the vessel, insurers, owners, operators, masters, crew and agents from any claim, including but not limited to injuries, re-injuries, death, damages, costs or losses.
I have read and understand this agreement in its entirety and agree that it will be binding to me, my minor children, heirs, next of kin, executors, administrators, insurers and successors.
Due to Mark van de Weg’s commitment to sailing magazines I am not to publish any pictures or articles about this trip without written permission from Mark van de Weg.
Disputes should be handled by the Court of Arbitration in Svalbard.
